1. Who These Terms Apply To

These Terms of Use ("Terms") govern your access to and use of gettuesday.app, including the Tuesday waitlist ("Service"), operated by Madhusudhan Madhulla ("we", "us", "our"), an individual based in Hyderabad, Telangana, India.

By accessing the website or submitting your email address to the waitlist, you agree to these Terms. If you do not agree, do not use the Service.

2. What Tuesday Is

Tuesday is a pre-launch AI-powered daily ritual intelligence application currently in development. The waitlist page at gettuesday.app allows interested users to register their email address to receive early access and launch updates.

Joining the waitlist does not guarantee early access, a specific position in the queue, or access to any particular features. Waitlist positions, queue numbers, and early access invitations are determined at our sole discretion. We reserve the right to modify, delay, or cancel the Tuesday launch at any time without liability to waitlist members.

3. Eligibility

You must be at least 18 years of age to use this Service. By submitting your email, you confirm that you are 18 or older. If you are under 18, you are not permitted to use this Service.

4. Your Waitlist Registration

When you join the waitlist, you agree to:

• Provide a valid email address that you own and control

• Receive emails from us related to Tuesday, including confirmation emails, launch updates, and your early access invitation

• Not register multiple email addresses to gain an unfair advantage

• Not use automated tools, bots, or scripts to submit to the waitlist

We reserve the right to remove any registration we believe violates these Terms, including duplicate registrations or registrations made in bad faith.

5. Communications

By joining the waitlist, you explicitly consent to receive email communications from us regarding Tuesday. These include:

• A confirmation email upon joining

• Development updates and announcements

• Your early access invitation

You can unsubscribe from these communications at any time by clicking the unsubscribe link in any email or by emailing privacy@gettuesday.app. Unsubscribing will remove you from all future communications but will not retroactively affect emails already sent.

6. Intellectual Property

All content on gettuesday.app, including but not limited to the Tuesday name, logo, design, copy, and code, is the exclusive property of Madhusudhan Madhulla and is protected under applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any content from this website without our prior written consent.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law

• Attempt to gain unauthorized access to any part of the website or its infrastructure

• Transmit any harmful, offensive, or disruptive content

• Interfere with the proper functioning of the website

• Scrape, harvest, or collect data from the website using automated means

• Impersonate any person or entity

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The website will be available at all times or free from errors

• The waitlist system will function without interruption

• Any specific features will be included in the final Tuesday application

To the maximum extent permitted by applicable law, we disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Madhusudhan Madhulla shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, including but not limited to loss of data, loss of profits, or loss of business opportunity.

Our total aggregate liability to you for any claim arising from or related to these Terms or the Service shall not exceed INR 500 (Indian Rupees five hundred) or USD 10 (United States Dollars ten), whichever is lower.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Madhusudhan Madhulla from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or your use of the Service.

11. Third-Party Services

The Service uses third-party tools including Loops.so, Framer, Google Analytics, and Cloudflare. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service providers.

12. Modifications to the Service and Terms

We reserve the right to:

• Modify, suspend, or discontinue the waitlist or the gettuesday.app website at any time, with or without notice

• Update these Terms at any time by posting the revised version on this page with an updated "Last updated" date

Your continued use of the Service after any modification constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, your only remedy is to stop using the Service and request removal from the waitlist.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, specifically the laws of the State of Telangana, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

For users outside India: You agree that any legal proceedings will be conducted in Hyderabad, India, under Indian law. By using the Service, you waive any objection to this jurisdiction.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy at gettuesday.app/privacy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
